GENERAL TRADE CONDITIONS

The following sale conditions are concluded between the company « Désuet PLC » whose registered office is at 100 rue de guisnes 59200 Tourcoing, registered with the Trade Register under number 530 803 500 00 013 hereinafter referred to as “Désuet PLC” and secondly, by any person or entity wishing to make a purchase via the website of “Désuet PLC” hereinafter known as ” the buyer”.

 

Subject

These sale conditions define the contractual relationship between “Désuet PLC” and the buyer and these conditions are applicable to all purchases made through the website site “Désuet PLC” that the buyer be either professional or non-professional.

The acquisition of goods or services through this website implies acceptance by the buyer of these terms of sale

These conditions shall prevail over any other general or special conditions not specifically approved by “Désuet PLC”

“Désuet LLC” reserves the right to modify the terms and conditions at any time. In this case, the conditions will be those in effect on the date of the order placed by the buyer.

It is understood that “Désuet PLC” sells products previously on sale elsewhere and that in this way no complaints will be possible on items that no longer meet French standards.

These products and services are available subject to stock.

Each product is accompanied by a description provided by “Désuet LLC”

The photographs in the catalogue (website) are as accurate as possible but can not ensure a perfect representation of the goods proposed, especially with regard to the product colours.

 

Rates

The prices listed in the catalogue (website) are priced in euros with legally applicable VAT included

“Désuet LLC” reserves the right to change prices at any time, however the price listed in the website on the day of the order shall be the price applicable to the buyer.

Prices include (or exclude) the cost of order processing, transportation and delivery if they take place in the outlined geographical areas

The buyer, who wishes to buy a product or service must:

Retraction

Buyers and non-professional individuals, have a period of fourteen days after the delivery of their order to return the product to the seller (Désuet PLC) for exchange or refund without penalty, except the cost of go and return postage.

 

Terms of Payment

Payment is due with the order.

Payments can be made by credit card; processed through the secure bank CIC and Paypal systems which use SSL (Secure Socket Layer) protocol so that the transmitted information is encrypted by software and no third party can access it during the online transaction. Paying by cheque or bank transfer is possible, however the shipment will take place once the order is paid for.

The buyer’s account will only be charged once the products or services available are dispatched/downloaded.

A receipt will be sent to the buyer.

 

Deliveries:

Deliveries are made to the address specified on the order form which has to be in the agreed geographical area.

During transportation Désuet LLC are no longer responsible for the goods once they leave the premises of “Désuet LLC” In case of damage during shipping, any complaint must be made with the carrier upon delivery.

Delivery times are for illustrative purposes only; if they exceed thirty days from the order, the contract may be terminated and the buyer refunded.

 

Warranty

All products supplied by the seller have the legal guarantee provided by Article 1641 of the Civil Code.

In case of non compliance of a product, it can be returned to the seller who will exchange or refund.

All complaints, requests for exchange or refund must be made in writing sent recorded delivery to the following address: 100 rue de guisnes, 59200 Tourcoing, within thirty days of delivery.

 

Responsibility

Désuet PLC, in the process of selling online is only bound by one obligation and therefore cannot be held liable for damages resulting from the use of the Internet such as data loss, hacking, viruses,, or other unintended problems.

 

Intellectual property

All elements of the site “Désuet PLC” are and remain the exclusive intellectual property of “Désuet PLC”

It is forbidden to reproduce, use, repost, or use for any purpose whatsoever, even partially, the elements of the website (i.e software, visual or sound).

Any single link or hyperlink is strictly prohibited without the written consent of “Désuet PLC”.

 

Personal data

According to the law relating to data, files and liberty dated January 6, 1978, any information containing names of buyers may be subject to automated processing.

“Désuet PLC” reserves the right to collect information on purchasers including the use of cookies, and, if desired, to transmit collected information to business partners.

Buyers may object to the disclosure of their details by notifying “Désuet LLC”. Similarly, users have the right to access and correct data concerning them, in accordance with the law of January 6, 1978.

 

Filing – Proof

“Désuet PLC” archive copies of purchase orders and emails in accordance with Article 1348 of the Civil Code.

The records held by “Désuet PLC” will be considered as proof of communication, orders, payments and transactions between both parties.

Dispute Resolution

These conditions of online sales are subject to French law.

In case of any dispute involving individuals or multiple defendants, jurisdiction is given over to the courts of Paris
